2. Basic Provisions:

2.1 For issues not regulated in this Terms and Conditions and for the interpretation of this Terms and Conditions, Hungarian law shall apply, with particular reference to Act V of 2013 on the Civil Code ("Ptk."), Act CVIII of 2001 on certain issues of electronic commerce services and information society services ("Elker. tv."), and Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses. The mandatory provisions of the applicable laws shall apply to the parties without the need for separate stipulation.

2.2 This Terms and Conditions is effective from the date of publication on the website (date at the end of the document) and remains in effect until revoked. The Service Provider has the right to unilaterally modify the Terms and Conditions. Any modifications will be published by the Service Provider on the website before they come into effect. By using the website, users accept that all regulations related to the use of the website automatically apply to them.

2.3 The User, by entering the website operated by the Service Provider or by reading its content in any way – even if they are not a registered user of the website – acknowledges the provisions of the Terms and Conditions as binding. If the User does not accept the terms, they are not entitled to use the website.

2.4 The Service Provider reserves all rights regarding the website, any of its details, the content appearing on it, and the distribution of the website. It is prohibited to download, electronically store, process, or sell any content or any part of it from the website without the Service Provider’s written consent.

3. Registration/Purchase

3.1 By making a purchase/registration on the website, the User declares that they have read and accepted the terms of this Terms and Conditions and the Privacy Policy published on the website.

3.2 The User is required to provide their own, accurate information during the purchase/registration process. In the case of false or misleading information, or if the data provided belongs to someone else, the resulting electronic contract will be null and void. The Service Provider disclaims any liability if the User uses services under another person's name or with another person's data.

3.3 Before submitting the Order, the Service Provider allows the User to correct the entered data. Therefore, the Service Provider disclaims full liability for any damage resulting from incorrect and/or inaccurate data provided by the User.

3.4 The Service Provider is not liable for any damages arising if the User forgets their password, or if the password becomes accessible to unauthorized individuals for any reason not attributable to the Service Provider.

4. Scope of Available Products and Services

4.1 The displayed products (tickets) can only be ordered online. The prices shown for the products are in Hungarian forints and do not include the VAT required by law.

4.2 The Service Provider provides detailed information about the product name and description on the website.

4.3 If a promotional price is introduced, the Service Provider will fully inform the Users about the promotion and its exact duration.

4.4 If, despite the Service Provider's diligence, an incorrect price is displayed on the website, particularly in the case of obviously erroneous prices, such as a price significantly deviating from the known, commonly accepted, or estimated price of the ticket, or due to a system error displaying a price of “0” HUF or “1” HUF, the Service Provider is not obligated to sell the tickets at the incorrect price but may offer the opportunity to purchase the tickets at the correct price, in which case the Customer can cancel the purchase.

4.5 In the case of an incorrect price, a significant discrepancy between the real and displayed price exists, which should be immediately noticeable to an average consumer.

According to Act V of 2013 on the Civil Code (Ptk.), a contract is formed when the mutual and consistent expression of the parties’ intent is made. If the parties cannot agree on the contractual terms, i.e., there is no mutual and consistent declaration of intent, the contract is not considered valid, and no rights or obligations arise from it. Therefore, an order confirmed at an incorrect price is considered void.

5. Order Process

5.1 The User can start the purchase without registration.

5.2 Tickets for the event can be ordered by pressing the “Buy Tickets” button, after which the User can modify the number of tickets desired on the ticket purchase page. After modification and updating the cart, and after entering the Contact and Billing details, the User will proceed to the checkout page by pressing the “Payment” button.

By accepting the Terms and Conditions, the User acknowledges that the personal data stored in the user database of Ecommerce Hungary (1066 Budapest, Dessewffy u. 18-20.) at https://marketplacesummit.hu/jegyvasarlas/ will be transferred to OTP Mobil Kft. (1093 Budapest, Közraktár u. 30-32.), as a data processor. The data transferred includes the following: email address, phone number, billing address details, and shipping address details.

The purpose of the data transfer: to execute the payment transaction, provide customer service assistance, confirm transactions, and conduct fraud monitoring to protect the users.

5.3 The User selects the payment method:

Online card payment and immediate transfer via the OTP Simple payment system.

5.3.1 No shipping costs are incurred during the purchase.

5.4 If there is an error or deficiency on the website regarding the tickets or prices, we reserve the right to correct it. In such a case, after identifying and correcting the error, we will immediately inform the customer of the updated information. The customer can then confirm the order again or may choose to cancel the contract.

5.5 The total amount to be paid includes all costs, as stated in the order summary and confirmation email.

5.6 After entering the details of the order and participants, the User can send the order by clicking the “Payment” button. Before submitting, they can review the provided information and may also send any other remarks related to the order via email.

5.7 Correction of data entry errors: The User can always return to the previous phase of the order process before finalizing it, where they can correct the entered data.

5.8 The User will receive an email confirmation after sending the order. If this confirmation does not arrive within the expected timeframe from the User's order submission, depending on the nature of the service, but no later than 48 hours, the User will be exempt from any obligation to honor the offer or contractual obligations. The order and its confirmation are considered received by the Service Provider and the User when they become accessible to them. The Service Provider disclaims responsibility for the confirmation if it does not arrive on time due to the User providing an incorrect email address during registration or if the mailbox is full.

5.9 The invoice for the ordered tickets will be sent electronically to the email address provided during the purchase.

6. Order Processing and Fulfillment

6.1 Orders are processed during business hours. Orders can also be placed outside the specified processing times, but if the order is placed after working hours, it will be processed the following day. The Service Provider’s customer service will always confirm when the order will be processed.

6.2 The general delivery time is within 1 business day from the successful payment.

6.3 In case of defective performance by the Service Provider, the User may assert a warranty claim according to the Civil Code rules.

7. Right of Withdrawal

According to Section 29 (1) l) of Government Decree 45/2014 (II. 26.), for contracts related to leisure activities, if a performance date or deadline is specified in the contract, the consumer cannot exercise the right of withdrawal.

For digital content provided not on a tangible medium (online ticket), if the business has started the performance with the consumer's explicit prior consent, and the consumer simultaneously acknowledged that after the performance starts, they lose the right to withdraw, the consumer cannot cancel the contract.

8. Miscellaneous Provisions

8.1 The Service Provider is entitled to use third-party assistance to fulfill its obligations. It is fully responsible for any illegal conduct by the third party as if the unlawful act were committed by the Service Provider itself.

8.2 If any part of this Regulation becomes invalid, unlawful, or unenforceable, it does not affect the validity, lawfulness, and enforceability of the remaining parts.

8.3 If the Service Provider does not exercise its rights under this Terms and Conditions, the failure to exercise such rights will not be considered a waiver of the rights. Any waiver of rights is only valid if expressly stated in writing. The fact that the Service Provider does not strictly enforce a material term or condition of this Regulation does not mean that the Service Provider waives enforcing the strict compliance with the given term or condition in the future.

8.4 The Service Provider and the User will attempt to resolve any disputes amicably.

9. Complaint Handling Process

9.1 The goal of our website is to fulfill every order with the appropriate quality and to the full satisfaction of the customer. If the User has any complaint regarding the contract or its fulfillment, they can communicate their complaint via the contact details provided in Point 1, either by phone, email, or letter.

9.2 The Service Provider will immediately review and address any verbal complaint. If the consumer disagrees with the handling of the complaint or if the immediate investigation is not possible, the Service Provider will record the complaint and its stance in writing and send a copy to the customer.

9.3 The Service Provider will respond in writing to any written complaint within 30 days. The Service Provider will justify its decision if the complaint is rejected. The record of the complaint and the response will be kept by the Service Provider for five years and presented to the regulatory authorities upon request.

9.4 According to the Consumer Protection Act (1997. CLV.), in the case of a consumer dispute, the consumer has the right to turn to the competent conciliation body. 9.5 Online Dispute Resolution Platform

The European Commission has created a website where consumers can register to resolve disputes related to online purchases without going to court. Consumers can resolve their disputes by filling out a request through this platform.

9.8 The conciliation body is responsible for resolving consumer disputes outside of court. The conciliation body attempts to mediate a settlement between the parties and, if unsuccessful, makes a decision to ensure simple, quick, effective, and cost-efficient enforcement of consumer rights.

The conciliation body will advise the consumer or the Service Provider on the rights and obligations of the consumer upon request.

9.9 For cross-border consumer disputes related to online sales or online service contracts, the dispute resolution procedure is solely under the jurisdiction of the conciliation body attached to the Chamber of Commerce and Industry of the capital.

9.10 The Service Provider is obligated to cooperate in the conciliation procedure. The Service Provider must send its response to the conciliation body and ensure that a person authorized to reach an agreement is present at the hearing. If the business’s registered office or place of operation is not located in the area of the conciliation body, the business is obligated to offer the possibility of a written agreement.

10. Copyright

10.1 The Service Provider reserves all copyright related to the ecommerce.hu and https://marketplacesummit.hu/ websites. Since ecommerce.hu and marketplacesummit.hu are considered copyright-protected works, it is prohibited to download (duplicate), retransmit, use in any other way, electronically store, process, or sell any content or any part of it from these websites without the Service Provider’s written consent.

10.2 Any materials from ecommerce.hu and marketplacesummit.hu and its database may only be used with written consent, and they must reference the respective website.

10.3 The Service Provider reserves all rights to its services, domain names, secondary domains, and internet advertising spaces.

10.4 It is prohibited to adapt or reverse-engineer the content or parts of the ecommerce.hu and marketplacesummit.hu websites; create user identifiers and passwords dishonestly; or use any application that allows modifications or indexing of any part of ecommerce.hu and marketplacesummit.hu.

10.5 The name ecommerce.hu and marketplacesummit.hu is copyright-protected, and its use is only allowed with the written consent of the Service Provider, except for referencing purposes.

10.6 The User acknowledges that unauthorized use will result in a penalty for the Service Provider.
